1. Agreement to Terms
By accessing our website, requesting a quote, or using any service provided by Emergency Mobile Tire Repair ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services
We provide mobile tire repair, roadside assistance, and mobile mechanic services in Central Florida. Service availability, response times, and pricing vary based on location, traffic, technician availability, vehicle type, parts availability, and weather. All quotes are estimates until the technician inspects the vehicle on-site.
3. Customer Responsibilities
- Provide accurate location, vehicle, and contact information.
- Ensure the service location is safe and legally accessible.
- Be the vehicle owner or have authorization to request service.
- Pay agreed-upon charges promptly upon completion.
4. Payment
Payment is due at the time of service unless otherwise agreed in writing. We accept major payment methods as communicated by your technician. Returned payments and chargebacks may incur additional fees.
5. Electronic Communications & SMS Opt-In
By providing your phone number and/or email address, you expressly consent to receive electronic communications from Emergency Mobile Tire Repair, including phone calls, SMS/text messages, and emails, related to your service request. These communications may include quotes, dispatch confirmations, technician ETA, job status updates, invoices, receipts, follow-up questions, and service-related notices.
Message frequency varies based on your service activity. Message and data rates may apply to SMS messages. Consent to receive text messages is not a condition of purchase.
Opt-out: Reply STOP to any text message to opt out of SMS, or use the unsubscribe link in marketing emails. For help, reply HELP, email emergencymobiletirerepair@gmail.com, or call (352) 531-6319. We may still contact you by phone or email regarding an active service request after you opt out of SMS.
We do not share or sell your mobile number or SMS opt-in information with third parties for their marketing purposes.
6. Warranties & Disclaimers
We strive to perform every job to a high standard. Except where prohibited by law, our services are provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Parts may carry manufacturer warranties; ask your technician for details.
7. Limitation of Liability
To the maximum extent permitted by law, Emergency Mobile Tire Repair is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid us for the service giving rise to the claim.
8. Indemnification
You agree to indemnify and hold Emergency Mobile Tire Repair harmless from any claims, damages, or expenses arising from your misuse of our services, breach of these Terms, or violation of any law or third-party right.
9. Cancellations & No-Shows
If you need to cancel a scheduled service, please notify us as soon as possible. Cancellations made after a technician has been dispatched may incur a trip fee.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Florida.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
